General Terms and Conditions of Sale
1. Introduction
Ekinium is an art gallery specializing in the sale of medieval European sculptures.
2. Nature of Sales and Authenticity
The works offered for sale on our website are original and authentic pieces. Each sculpture is accompanied by documentation certifying its origin and, if available, a certificate of expertise.
3. Prices and Payment
Prices are indicated in euros (€) and are subject to change without prior notice.
Payment in euros (€) or US dollars (USD) is accepted via bank transfer, credit card, or any other approved secure payment method.
The price of the artwork does not include shipping costs, insurance, and applicable taxes (VAT, customs duties, etc.), which are the responsibility of the buyer.
The sale is considered final once full payment has been received.
4. Shipping and Insurance
Shipping is carried out after full payment has been confirmed, including all applicable fees (customs, transport, insurance).
Risks related to transportation are transferred to the buyer once the artwork is handed over to the carrier.
The buyer may take out additional insurance to cover transport.
We are committed to packing each artwork with the utmost care to ensure optimal protection.
5. Right of Withdrawal (For Online Sales Only)
In accordance with current regulations, the buyer has a period of 14 days from the receipt of the artwork to exercise their right of withdrawal.
The return must be previously reported and approved by Ekinium.
The artwork must be returned in its original condition and with all accompanying documents.
Return shipping and insurance costs are the responsibility of the buyer.
No refund will be issued in the event of deterioration or modification of the artwork.
The right of withdrawal does not apply in cases where the artwork is delivered in person during an appointment agreed upon with the buyer.
6. Claims and Guarantees
Any claim regarding damage occurring during transport must be addressed directly to the carrier, with a copy sent to Ekinium within 48 hours of receipt.
We guarantee the authenticity of the artworks sold, but we do not offer a buy-back guarantee in case of an evolution in scientific expertise.
7. Buyer’s Obligations
The buyer must provide accurate and verifiable information (name, address, contact details).
They agree that all communications related to the sale may be sent via email.
Any false declaration or attempt at fraud will result in the immediate cancellation of the transaction.
8. Ownership of Artwork Photographs
Ekinium retains ownership and usage rights of the photographs of the artworks sold. We reserve the right to publish these images, including after the sale, for documentation, archiving, or communication purposes.
9. Disputes and Jurisdiction
In the event of a dispute, an amicable solution will be prioritized.
Failing an agreement, any dispute will be submitted to the competent courts in Paris, France.
10. Modification of Terms
Ekinium reserves the right to modify these terms of sale at any time. The applicable terms are those in force at the time of purchase.
